With reference to the first instance mentioned by the Acting Attorney General
in which the recommendation of Committee has not been adopted, I would state that at one time I thought that the birch might be substituted for the cat-o'-nine-tails in cases of whipping ordered by the Superintendent, but on further consideration of the subject, I am of opinion that it would weaken the position of the Superintendent of the Gaol to have his power of punishment reduced in this or in any way.
Further, whipping with the birch would be a very small punishment and useless as a deterrent to many prisoners. The consequence of this would be that the prisoner would become hardened and have to be brought before ...
